Contracting Incentives

Native American organizations and Native American-owned economic enterprises shall have the maximum practicable opportunity to participate in performing contracts awarded by Federal agencies. In fulfilling this requirement, the Native American Incentive Program allows an incentive payment equal to 5 percent of the amount paid to a subcontractor in performing the contract; if the contract so authorizes and the subcontractor is a Native American organization or Native American-owned economic enterprise.
What is the Native American Incentive Program?
For actions after 13 September 2001, sub-tier contractors who subcontract to an Indian-owned firm are eligible for the incentive payments by the Prime inserting DFARS Clause 252.226-7001 in the contract. The program provides for an incentive payment of 5% of payments made by a prime contractor to Native American subcontractors. Funding for this program is set aside under the Indian Financing Act.
Who can qualify for payments?
Incentives are available on all currently open and qualifying DoD contracts with Native American subcontracts. Requests can be retroactive.
What is the process for requesting an eligible payment?
You can request an incentive payment by sending a claim to the contracting office. The contracting officer than submits the claim to the Agency Small Business Office, which processes payment. Agency Small Business Offices have a point of contact that the contracting officer can contact to obtain information on how to submit a claim for incentives payment.
